SIZWE UPDATE
13 November 2018
Linksfield / Sandringham / Edenvale
The Tribunal Committee has ruled that the development may go ahead subject certain conditions. It is very distressing that there are no conditions precedent regarding health precautions and other matters. It appears as if all the representations in this regard has been ignored by the tribunal.
For the time being it does not really matter as representations and lobbying to other government agencies did not fall on deaf ears.
April 2018 Cease Works Order by the South African Heritage Council to stop work being done by the developer prior to any approvals being granted.
September 2018 a directive from The Cultural, Religious and Linguistic Chapter Nine Institution to the Gauteng Province GDRD (Gauteng Rural development) to withdraw/rescind their authorization for the development of the site. It was found that the correct processes were not followed and the relevant Heritage Report had not been done or been submitted for approval. This had been pointed out over and over to the relevant authorities and the Tribunal on two occasions.
My sincere thanks to the small group of activists who did not give up and continued to fight for the rights and interests of their communities. Intimidation, threats to their personal safety and ridicule was the order of the day. We will however remain vigilant to ensure that no back door attempts are used to force this matter through. The road from the development to Edenvale Aitken Road would have been catastrophic for the town.
It now means that the matter must be appealed however clarity has to be provided with regard to the CRL intervention. It was reported the developer was recently fined R 700k by GDRD for environmental based transgressions in another of his developments and has had to provide a personal undertaking that it will not happen again. Building houses on graves/ grave yard was ruled against in the Western Cape High Court in the Oudekraal matter. We fail to understand how the Jhb Metro and the Tribunal can support and authorize this development We now have 28 days to appeal, we are awaiting clarity on the CRL embargo placed on the development. It has taken them more than a year to make a finding and the community, ordinary lay people are given 28 days to raise an appeal against the development. The banks of legal advisors and representatives, accountants and administrative support staff used by the developer, not available to the objectors make it even more “Fair”
The original 8000 mixed income use houses announced has now been greatly reduced to below 5000k We are very doubtful whether the developer will be able to comply with the low cost/affordable component of the development. Only 2500 graves have been identified where several sources indicate up to 6000 to 8000 graves are on the site. Jhb Municipality confirmed in 1986 that their records reflected 6000 graves. People who died from Bubonic Plague, Anthrax, Small Pox, Hemorrhagic Diseases, Virulent strains of TB and many more were buried on the site. The cultural and religious rights of the family members of the people buried there are being grossly violated The very flawed tender process for the development has just been white washed. There was collusion, malicious compliance and political interference of note, again white washed. You need to question the urgency of issuing a tender like this during the compulsory closure in December of the building and construction industry. A DG of GDRD in charge during 2011 resigned and surfaced 6 months later as a joint co operative venture partner of the environmental company that did the EIA.
